Welcome to VĀRIHĀ.
VĀRIHĀ is a trading name of Variha Fragrance Ltd ("VĀRIHĀ", "we", "our" or "us").
These Terms of Service ("Terms") govern your use of our website and the purchase of products from us.
By using our website or placing an order with us, you agree to these Terms together with any policies referred to in them, including our:
- Privacy Policy;
- Returns & Refund Policy; and
- Shipping Policy.
Our online store is hosted using the Shopify e-commerce platform.
Please read these Terms carefully before placing an order.
Nothing in these Terms affects any rights you have under applicable UK consumer law.

2. Using Our Website
You may use our website only for lawful purposes.
When using our website or placing an order, you agree that:
- the information you provide to us is accurate and complete;
- you will not use the website fraudulently or unlawfully;
- you will not attempt to interfere with the operation or security of the website; and
- you will not attempt to gain unauthorised access to our systems, accounts or data.
If you are under 18, you should use our website and purchase products only with the involvement of a parent or legal guardian.
We may restrict or suspend access to our website where reasonably necessary to protect our customers, business, website or systems.
3. Products
VĀRIHĀ specialises in fragrances and related products.
We take reasonable care to ensure that product descriptions, photographs, specifications and other information displayed on our website are accurate.
However, there may occasionally be minor differences between the way a product appears on screen and the physical product you receive.
For example:
- colours may appear slightly different depending on your screen or device;
- product packaging or presentation may occasionally change;
- manufacturers may update packaging, labelling or presentation; and
- fragrance packaging may differ slightly between production batches.
Any such differences will not affect your statutory rights where a product is faulty, materially different from its description or otherwise does not comply with applicable consumer law.
Products are subject to availability.
We may change or discontinue products displayed on our website at any time before we have accepted an order for those products.
4. Fragrance Information
Fragrance is subjective and may develop differently depending on factors such as individual skin chemistry, application, environment and personal perception.
Descriptions of fragrance notes, character, longevity, projection, seasonality or suitability are provided to help customers understand the product but are not guarantees of how a fragrance will smell or perform for every individual.
Personal dislike of a fragrance or a fragrance not matching an individual's expectations does not, by itself, mean that the product is faulty.
This does not affect your statutory rights if a product is faulty, damaged, incorrectly supplied or not as described.
5. Product Safety
Please use all products in accordance with the instructions, warnings and information provided on the product and its packaging.
Fragrances are generally intended for external use only.
You should:
- avoid contact with the eyes;
- avoid application to broken or irritated skin;
- keep products out of the reach of young children;
- follow any storage instructions displayed on the product or packaging;
- keep products away from sources of heat or ignition where indicated by the product warning; and
- discontinue use if irritation or an adverse reaction occurs.
If you have known sensitivities or allergies, you should review the ingredients and product information before use.
Product-specific instructions and warnings on the product or packaging should always be followed.
6. Prices
All prices displayed on our website are in Pounds Sterling (£ GBP) unless otherwise stated.
Variha Fragrance Ltd is not currently registered for VAT and VAT is therefore not separately charged on our sales.
Delivery charges, where applicable, are shown separately before you complete your order.
We may change product prices at any time, but a price change will not affect an order that we have already accepted.
Despite our reasonable efforts, a product may occasionally be incorrectly priced.
If we discover an obvious pricing error before accepting your order, we may:
- contact you and offer you the opportunity to purchase the product at the correct price; or
- cancel the affected order and refund any amount you have already paid.
We will not knowingly rely on an obvious pricing error to supply a product at a materially incorrect price.
7. Placing an Order
When you place an order through our website, you are making an offer to purchase the products in your order.
After placing your order, you will normally receive an order confirmation acknowledging that we have received it.
An order confirmation is an acknowledgement of your order and does not by itself mean that we have accepted your order.
A contract for the purchase of the products is formed when we send you confirmation that your order has been dispatched.
We may decline or cancel an order before acceptance where reasonably necessary, including where:
- a product is unavailable;
- we are unable to authorise or process payment;
- there has been an obvious pricing or product information error;
- we cannot deliver to the address supplied;
- purchase limits have been exceeded;
- we reasonably suspect fraud, unauthorised payment or misuse of our website; or
- we are unable to fulfil the order for another legitimate reason.
If we cancel an order for which payment has already been taken, we will refund the amount paid for the cancelled products.
8. Payment
Payment must be made using one of the payment methods offered at checkout.
Payments may be processed by Shopify Payments and/or other authorised payment service providers made available through our store.
Payment methods available to you may depend on your device, location and the payment services available at the time you place your order.
We do not receive or store your full payment card number.
You confirm that you are authorised to use the payment method selected for your order.
We will not dispatch an order unless the required payment has been successfully authorised or otherwise accepted by the relevant payment provider.
9. Shipping and Delivery
We currently deliver to addresses within the United Kingdom only.
The delivery methods available to you, applicable delivery charges and estimated delivery timeframe will be displayed during checkout.
Our current processing arrangements, delivery services, charges and estimated transit times are explained in our separate Shipping Policy.
Where an estimated delivery date or delivery date range is displayed at checkout, it represents the expected arrival timeframe for that order based on the information available at the time.
Delivery dates and transit times are estimates unless we expressly state that a particular delivery date is guaranteed.
Occasionally, delivery may be affected by circumstances outside our reasonable control, including severe weather, carrier network disruption, industrial action, public holidays or unusually high seasonal demand.
We will take reasonable steps to assist where a delivery is delayed.
Nothing in this section limits your statutory rights relating to delivery.
Unless another delivery period has been agreed with you, we will deliver your goods within the period required by applicable consumer law.

10. Risk and Ownership
Where we arrange delivery of your order, the products remain at our risk until they are delivered to:
- you; or
- another person nominated by you to receive them.
If you independently arrange for a carrier to collect your goods and that carrier was not offered by us as a delivery option, different rules regarding risk may apply.
Ownership of the products will pass to you once we have received payment in full and the products have been delivered to you.
Nothing in this section affects your statutory consumer rights.
11. Cancellations, Returns and Refunds
Your rights to cancel an order, return a product or request a refund are explained in our separate Returns & Refund Policy.
For most eligible goods purchased online, consumers have a statutory cancellation period under UK consumer law, subject to applicable exceptions.
Certain categories of sealed goods may be excluded from the statutory right to cancel after they have been unsealed where the legal health-protection or hygiene exception applies.
We do not rely on this exception to limit any rights you have where a product is:
- faulty;
- damaged;
- not as described;
- incorrectly supplied; or
- otherwise not in conformity with your statutory rights.

Nothing in these Terms or our Returns & Refund Policy affects your statutory consumer rights.
12. Faulty or Damaged Products
We are required to supply goods that comply with applicable consumer law.
If a product you receive is faulty, damaged, not as described or otherwise does not meet the standards required by law, you may have legal rights to a repair, replacement, price reduction or refund depending on the circumstances.

Where helpful, we may ask you to provide photographs of the product and packaging so that we can investigate the issue efficiently.
Requesting photographs does not affect your statutory rights.
13. Promotions and Discount Codes
From time to time, we may offer promotions, discounts, promotional codes or complimentary delivery.
Unless otherwise stated:
- promotions are subject to availability;
- promotional codes must be used before their stated expiry date;
- promotional codes cannot normally be exchanged for cash;
- only one promotional code may be used per order unless expressly stated otherwise; and
- additional conditions may apply to a particular promotion.
Any specific conditions displayed with a promotion form part of that promotion.
We reserve the right to withdraw or amend a promotion before an order has been accepted where there has been an error, misuse or other legitimate reason to do so.
This does not affect orders already accepted by us.
14. Intellectual Property
Unless otherwise stated, the content made available through our website is owned by or licensed to Variha Fragrance Ltd.
This may include:
- the VĀRIHĀ name and branding;
- logos;
- photographs;
- graphics;
- product descriptions;
- written content;
- videos;
- website design and layout; and
- other creative materials.
You may access and use our website for your own personal and non-commercial shopping purposes.
You must not reproduce, distribute, publish, modify, commercially exploit or otherwise use our protected content without our prior written permission, except where permitted by law.
Nothing in these Terms transfers ownership of any intellectual property rights to you.
Third-party trademarks, product names and other intellectual property remain the property of their respective owners.
15. Acceptable Use
You must not knowingly:
- use our website for unlawful or fraudulent purposes;
- introduce viruses, malware or other harmful technology;
- attempt to gain unauthorised access to the website or systems connected to it;
- interfere with the operation, availability or security of the website;

Loss or damage is foreseeable where it was obvious that it might happen or where, when the contract was made, both you and we knew that it might happen.
We are not responsible for loss or damage that is not reasonably foreseeable.
Nothing in these Terms excludes or limits our liability for:

- fraud or fraudulent misrepresentation;
- liability for defective products where that liability cannot lawfully be excluded or restricted; or
- any statutory consumer right or other liability that cannot lawfully be excluded or restricted.
19. Your Statutory Rights
These Terms are intended to operate alongside, and not replace or restrict, your rights under applicable consumer protection law.
Nothing in these Terms excludes, restricts or reduces any rights or remedies that cannot legally be excluded or restricted.
If there is a conflict between these Terms and a mandatory consumer right, the mandatory consumer right will apply.

We process personal information in accordance with applicable data protection law and our Privacy Policy.

- the way we operate our online store.

The version of these Terms in force when you place an order will normally apply to that order.
Changes made after an order has been accepted will not retrospectively alter that contract unless:
- the change is required by law; or
- you expressly agree to the change.
22. If Part of These Terms Is Invalid
If a court or other competent authority decides that any provision of these Terms is unlawful, invalid or unenforceable, that provision will be treated as removed or limited to the extent necessary.
The remaining provisions will continue to apply.
23. No Waiver
If we do not immediately enforce a right or remedy available to us under these Terms, this does not mean that we have waived that right or remedy.
Similarly, exercising a right or remedy on one occasion does not prevent us from exercising it again where appropriate.

These Terms and any contract between you and us are governed by the laws of England and Wales.
If you live in another part of the United Kingdom, you will also benefit from any mandatory consumer protections available to you under the laws applicable where you live.
Nothing in these Terms removes any right you may have as a consumer to bring proceedings in a court that has jurisdiction under applicable law, including any right you may have to bring proceedings in your local courts.
